1. Evaluation and licence grant

The Software includes a seven-day evaluation period beginning when it is first installed. During that period, it operates with full functionality and no licence code is required. To continue using the Software after the evaluation period, purchase and activate a commercial licence. Subject to this EULA and payment of the applicable licence fee, we grant you a personal, non-exclusive, non-transferable except as set out below, revocable licence to install and use the Software on up to three devices for your own personal or commercial work. The licence is for the named user. You may request a transfer to another named user by contacting support; we will consider reasonable requests.

2. Permitted use and restrictions

You may use the Software to create recordings, performances, sound effects, music, and other original work, including work made for commercial clients. You may not rent, lease, lend, sell, sublicense, distribute, publish, make available, or otherwise redistribute the Software, its installer, licence code, factory presets, or any substantial part of them. You may not reverse engineer, decompile, disassemble, or attempt to derive source code from the Software except to the limited extent that applicable law expressly permits that activity despite this restriction.

3. Ownership

The Software is licensed, not sold. Digital Pragmatics and its licensors retain all intellectual-property rights in the Software. This EULA gives you no ownership interest in the Software, its name, artwork, documentation, or underlying technology.

4. Updates and upgrades

Your perpetual licence includes all minor revisions of the purchased version and one subsequent major version of Polecat Blur. We may provide updates, fixes, or improvements at our discretion. Nothing in this EULA requires us to maintain a particular feature indefinitely, but an update will not deliberately remove the core functionality described for the version you purchased without a reasonable replacement.

5. Support

Support is included for the applicable upgrade period. We aim to reply within three working days to requests concerning installation, activation, licence recovery or transfer, and reproducible bug reports. Support does not include configuration or troubleshooting of third-party hardware, DAWs, operating systems, plug-ins, or projects; bespoke sound design; or custom development.

6. Refunds

We offer a no-quibble refund within 30 days of purchase. Contact support with the purchase details and the licence will be cancelled. This policy does not limit any statutory consumer rights that cannot lawfully be excluded.

7. Disclaimer and liability

The Software is provided for sound-design and music-production use. To the maximum extent permitted by law, we exclude implied warranties and conditions that are not expressly stated in this EULA. Nothing here excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited. Subject to that, our total liability arising from the Software or this EULA is limited to the amount you paid for the Software in the 12 months before the event giving rise to the claim. We are not liable for indirect or consequential loss, loss of profit, loss of data, loss of business, or loss of goodwill.

8. Termination

This EULA continues for as long as you comply with it. It terminates automatically if you materially breach its terms. On termination, you must stop using the Software and remove all copies in your possession or control. Sections concerning ownership, restrictions, disclaimer and liability, governing law, and any provisions intended to survive termination will continue to apply.

9. Governing law

This EULA and any dispute or claim arising from it are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that a consumer may have mandatory rights to bring a claim in their home jurisdiction.
